The BeeBuzzPoints (the "Service"), operated by Triton Loyalty, and SACBEE (together, Triton Loyalty and SACBEE are referred to as "we", "us" or "our") is provided to you ("you," "your" or "User") under the following terms and conditions, including any amendments thereto and any additional terms and conditions, rules or policies that may be applicable to particular offerings made in connection with the Service (collectively, the "Terms and Conditions"). We reserve the right to update or change these Terms and Conditions from time to time. Any such changes shall be reflected in an updated version of the Terms and Conditions posted on this site. By continuing to use the Service following the posting of any such change, you will be deemed to have agreed to the amended version of the Terms and Conditions. Any failure to comply with these Terms and Conditions by you may result in the termination of your account, and the forfeiture and relinquishment of all Points you have accrued in the Service. BY REGISTERING TO USE THE SERVICE, YOU AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS, SO PLEASE READ THEM CAREFULLY.
Description of the Service
The Service is a program where registered users can accrue Points by engaging in certain activities and can redeem Points for certain offers ("Rewards"). Points accrued in the Service are non-transferable to other users or accounts and have no cash or monetary value. Some Rewards provided through the Service by way of auctions, sweepstakes, or trade-ins are promoted regionally or nationally to users of other rewards services. Rewards that are promoted and accessible only to users eligible to participate in this Service are noted as such by the display of the reward type 'L' on the page displaying the material terms for that sweepstake, auction or trade-in. Rewards promoted and accessible to users in multiple Services within this market or across multiple markets are noted as such by display of the reward type 'MM' on the page displaying the material terms for that sweepstake, auction or trade-in.
Unless otherwise specified in connection with particular offerings, participation in the Service is open only to natural persons who are 13 years of age or older. Employees or agents of SACBEE, Triton Loyalty, and each of their respective affiliates, and immediate family members of or persons domiciled with any such persons are not eligible to participate.
Reservation of Rights
The Service and its benefits are offered at our discretion, and we have the right to modify or discontinue, temporarily or permanently, the Service, including the Points levels, in whole or in part for any reason, at our sole discretion. We may, among other things, withdraw, limit, modify or cancel any Reward; increase the Points required for any Reward; or modify or condition the transferability of Rewards or benefits. You agree that we will not be liable to you or any third-party for any modification or discontinuance of the Service, in whole or in part.
In consideration of your use of the Service, you agree to provide true, accurate, current and complete information about yourself as prompted by the registration form and to maintain and promptly update your personal data to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, not current or incomplete, or if we or any of our service providers have reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, we have the right to suspend or terminate your account and to refuse any and all current or future use of the Service (or any portion thereof) by you. You may not register with a disposable email address. Only one member account per person and two member accounts per household. If you are 13 years of age or under you cannot post information about yourself on the website or complete the registration process. You can, among other things, review your accumulated Points, review the Terms and Conditions as amended from time to time, and review redemption options at buzzpoints.sacbee.com .
You will receive a password and account designation upon completing the registration process. You agree to maintain the confidentiality of your password and account, and that you are fully responsible for all activities that occur under your password or account. You agree to immediately notify us of any unauthorized use of your password or account or any other breach of security, and to exit from your account at the end of each session. We will not be liable for any loss or damage arising from your failure to comply with these conditions. If for any reason your account is terminated by either you or us, all of your Points accrued will be forfeited.
To earn Points, you must undertake an activity described in a Service-authorized promotion for earning Points, which may include, but is not limited to: streaming media on a designated media player, completing certain surveys, visiting certain retail locations or Internet Web sites, registering for a designated product or service or engaging in other online activities for which Points will be awarded in connection with the Service. You also will be rewarded a percentage of the total Points that your primary referrals earn on their use of the Service. We expressly reserve the right to change the rate at which referred Points are credited and to limit the amount of referred Points credited to your account each week to an overall maximum number of Points that may be less than the number of member referred Points that would have been credit based on the current percentage being paid. We also expressly reserve the right to establish additional means of accruing Points, to delete any or all of the means currently in effect, to exclude specific types of transactions from the accumulation of Points or to specify periods after which unused Points will be forfeited. Points can be accrued only for activity actually taken and completed by you or by your primary referrals and can be applied only to your account. You may earn Points from only one computer or network access point at any given time; simultaneous activity on multiple computers for one account will not be credited. Streaming activity is further limited to one stream at a given time. You may accrue Points simultaneously for non-streaming activity, provided it is in accordance with the conditions regarding network access Points and multiple computers. Points posted to your account for transactions that are subsequently voided will reduce the Points accrued in your account by the number of Points earned for the corresponding voided transaction. We will use reasonable efforts to allocate earned Points to each user's account. However, you are responsible for ensuring that your Points are properly credited. If you believe that Points have been earned but not credited, or in cases where we deem verification is required, we reserve the right to require proof of accrual, including, but not limited to, copies or receipts or similar documentation verifying any transactions claimed to have been performed. We must receive any claims of Points by you and proof of accrual within three months after the date such Points are claimed to be earned. Points will be maintained in your account until they are redeemed for a Reward or for 6 months or are forfeited whichever occurs first. Each month, all Points that are more than 6 months old will be deleted from your account. All decisions regarding point balances, rewards, and forfeitures, and the identity of the individual accessing an account, are within our sole discretion.
You may redeem Points accrued in your account for Rewards, provided that your account is in good standing at the time of the redemption request. You may use your Points to submit Sweepstakes entries, each of which is subject to their own official rules available on the entry screen. You are required to be 18 years or older to bid in certain auctions, to be eligible for certain trade-ins or to submit certain Sweepstakes entries. Some Rewards provided through the Service by way of auctions, sweepstakes, or trade-ins are promoted regionally or nationally to users of other rewards services. Rewards that are promoted and accessible only to users eligible to participate in this Service are noted as such by the display of the reward type 'L' on the page displaying the material terms for that sweepstake, auction or trade-in. Rewards promoted and accessible regionally or nationally to users of this Service and other rewards services are noted as such by display of the reward type 'MM' on the page displaying the material terms for that sweepstake, auction or trade-in. In these cases, users of other rewards services in multiple cities will have the ability to participate in auctions, sweepstakes, and trade-ins available through the Service, which in turn may further limit the availability of the items offered to you through the Service. All active bids and sweepstakes entries will remain active and eligible for winning prize until the member is outbid or the sweepstakes entered closes. For these purposes, items will be deemed to be received on the date that you receive notice of an item being awarded in an auction or trade-in or a prize being awarded in a sweepstakes. Points earned in two or more different accounts may not be combined to redeem or bid for any Reward. Some Rewards have limited availability and all Rewards are subject to availability and other terms and conditions. Dependent upon availability, we may substitute Rewards of greater or equal value. In some cases, Rewards you select are sent to you directly by the merchant, who is solely responsible for the quality and performance of the goods supplied. Any rules of the merchants relating to returns and exchanges apply, but no Points will be re-credited to your account. You are responsible for taxes, if any, due on Points or Rewards. We reserve the right to modify or cancel any Reward offering at any time. Redeemed Rewards are not refundable, exchangeable, replaceable, redeemable, or transferable for cash, credit, other Rewards, or Points under any circumstances.
To play some of the games offered through the Rewards Service (including, but not limited to, scratch and win games, blackjack-style games, and slots-style games), you must submit the required number of Points, at which time the Points will be deducted from your account. The minimum number of Points required for a game play will be determined separately for each game, but typically range from 25 to 5000 Points . Once submitted, your game play cannot be deleted, canceled or modified, except by the Operator. In the event of a dispute as to game play submitted by multiple individuals using the same computer, an entry will be deemed to have been submitted by the authorized registrant of the Rewards Service username and password from which the game play is made. The authorized registrant is deemed to be the natural person who is assigned a username and password, and all decisions regarding the identity of the authorized registrant shall be made by Operator in its sole discretion. You may also participate in games that require Points to play through an offline method. No Points are required for an offline play. To play a game offline, you must mail a 3" x 5" card to Triton Loyalty, 500 Chastain Center Blvd., Suite 595, Kennesaw, GA 30144. Limit one card per outer postmarked envelope. The card must include the following information in legible, hand-printed or typed English: your full legal name, complete home postal address, home telephone number with area code, the user name and email address you entered when you registered for the Service, your age, gender, [insert name of station and/or Rewards Service], and the name of the game you wish to play. Each offline submission will entitle you to the number of Points needed to play the game identified in your offline submission once. Operator will deposit that number of Points into your account, and then you can play the game by submitting those Points in the manner described above. Operator is not responsible for any incomplete, late, lost, misappropriated, illegible, damaged, postage-due or misdirected mail-in entries or game play requests, or for failure to receive online entries or game play requests due to transmission failures or technical failures of any kind, including, without limitation, malfunctioning or unavailability of any network, hardware or software, whether originating with sender or Operator.
Gaming or Fraud
Gaming, fraud or abuse relating to the accrual of Points or redemption of Rewards may result in forfeiture of accrued Points as well as the termination of your account. You are solely responsible for any fraudulent use of your Points that could occur due to the theft of or sharing of your password. The Service is provided to individual users who are natural persons for their own personal use. Machines, scripts or automated services may not be used to access any part of the Service, accumulate any Points, or participate in any other aspect of the Service. IT WILL BE CONSIDERED FRAUDULENT AND A VIOLATION OF THE TERMS AND CONDITIONS IF YOU ACCESS ANY OTHER REGISTERED USER'S ACCOUNT TO TAKE ANY ACTION, INCLUDING BUT NOT LIMITED TO ENTERING CODES, TRIVIA ANSWERS, COMPLETING SURVEYS, OR REDEEMING Points FOR PRIZES AND AWARDS, EVEN IF THE OTHER REGISTERED USER IS A FAMILY MEMBER. IT WILL BE CONSIDERED FRAUDULENT AND A VIOLATION OF THESE TERMS AND CONDITIONS FOR ANY MEMBER TO SHARE WITH OTHER MEMBERS CODE WORDS, TRIVIA ANSWERS OR OTHER INFORMATION THAT CAN BE REDEEMED FOR Points. IT IS CONSIDERED FRAUDULENT AND A VIOLATION OF THESE TERMS AND CONDITIONS FOR ANY MEMBER TO REDEEM CODE WORDS, TRIVIA ANSWERS, OR OTHER INFORMATION THAT CAN BE REDEEMED FOR Points THAT WAS RECEIVED FROM OTHER MEMBERS. ANY MEMBER SHARING IN THIS MANNER OR REDEEMING INFORMATION SHARED IN THIS MANNER WILL HAVE THEIR ACCOUNT DELETED AND WILL NOT BE AWARDED ANY REWARDS. IT WILL ALSO BE CONSIDERED FRAUDULENT AND A VIOLATION OF THESE TERMS AND CONDITIONS FOR ANY INDIVIDUAL OR COMPANY TO DIRECT, ENCOURAGE, OR ALLOW INDIVIDUALS TO USE A SINGLE ACCOUNT FOR THE PURPOSE OF ACCUMULATING Points FOR COMPANY USE. VIOLATIONS WILL BE PROSECUTED TO THE FULL EXTENT OF THE LAW.
Limitation of Liability, Indemnity and Release
UNDER NO CIRCUMSTANCES SHALL WE BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL OR EXEMPLARY DAMAGES (EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), ARISING FROM THE USE OF OR INABILITY TO USE THE SERVICE OR ANY OTHER PROVISION OF THESE TERMS AND CONDITIONS. BECAUSE SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, IN SUCH STATES, OUR LIABILITY IS LIMITED TO THE EXTENT PERMITTED BY LAW. BY USING THE SERVICE YOU AGREE THAT OUR TOTAL LIABILITY FOR ANY ACTION, CLAIM OR JUDGMENT, REGARDLESS OF THE NATURE OF THE CLAIM OR THEORY OF LIABILITY, SHALL BE LIMITED TO YOUR ACTUAL OUT OF POCKET EXPENSES INCURRED IN CONNECTION WITH YOUR USE OF THE SERVICE, BUT IN NO EVENT ATTORNEY'S FEES. You accept all responsibility for, and hereby indemnify and hold us harmless from and against, any actions taken by any user authorized to use your account, including, but not limited to, accrual of Points, redemption of Points, and disclosure of passwords to third parties. We are not responsible for any incorrect or inaccurate information, whether caused by data entry errors by us, website users or by any of the equipment or programming associated with or utilized in the Sweepstakes or by any technical or human error which may occur in the set up or processing of the service. We assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of entries. We are not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line-systems, servers or providers, computer equipment, software, failure of email or players on account of technical problems or traffic congestion on the Internet or at any website or combination thereof, including injury or damage to participants or to any person's computer or data related to or resulting from participating or downloading materials in this Web site. We are not responsible for cheating or fraud by any members. By using the Service, you release us, our subsidiaries, and affiliates from any and all liability regarding the redemption of Points, use of Rewards, or other participation in the Service.
Violation of the Terms
You understand and agree that in our sole discretion, and without prior notice, we may remove Points from your account as a penalty, terminate your access to the website or deactivate your membership account if we determine that you have violated our Terms and Conditions.
You agree to indemnify and hold us, our subsidiaries, affiliates, officers, agents and other partners and employees, harmless from any loss, liability, claim or demand, including reasonable attorney's fees, made by any third party due to or arising out of your use of the website, including, without limitation, any information or content you post to the site or any interference with the operation of the site.
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Georgia, without giving effect to any conflicts or choice of laws rules (whether of Georgia or any other jurisdiction). The invalidity or unenforceability of any provisions of these Terms and Conditions shall not affect the validity or enforceability of any other provision. In the event that any provision of these Terms and Conditions is found to be invalid or unenforceable, these Terms and Conditions shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein. The Service and its components, including all trademarks, trade names and logos, are the property of Triton Loyalty and/or its licensors, which reserves all rights to such property.

SACBEE and Triton Loyalty (collectively, 'us', 'we', 'Operators') have created this privacy statement in order to demonstrate our firm commitment to privacy. The following discloses our information gathering and dissemination practices for the BeeBuzzPoints website ('Site').
GENERAL PRIVACY GUIDELINES
We use your Personal Information to provide you with the features, services, or goods you request and to respond to billing and/or other such questions related to the Operators or Site. We will also use your Personal Information to notify you about updates, new features, programming and activities on behalf of the Operators, Site, or our Advertisers that may be of interest to you. (We explain below in the next section what our policy is for the collection, use and disclosure of Personal Information to Advertisers.)
We may also use your information for hiring, operational and business purposes, or to find out how we can improve our Site via surveys or online tracking mechanisms. We use operational service providers to efficiently provide the full range of content, activities and membership services we bring to you and we request that our operational service providers also protect your privacy and not disclose your Personal Information or Sensitive Personal Information to third party marketers that are not associated with the Operators or website. We reserve the right to collect Personal Information using any new technology yet to be developed and to use such technology to provide new services and features to you, as well as for marketing and promotional purposes. WEBSITE COLLECTION, USE, AND DISCLOSURE OF PERSONAL INFORMATION
Our Site's registration form requires users to give us contact information (like their first and last name, mailing address, phone number, and email address) and demographic information (like their zip code, age, or gender). We use customer contact information from the registration form to send the user information about the rewards service, and to notify and ship prizes to the winners of auctions, sweepstakes, or contests as well as mail checks for cash earned on purchases made through the rewards service. The customer's contact information is also used to contact the visitor when necessary. We give users the option to remove their information from our database, to not receive future communications, or to no longer receive our service, by submitting your request to Member Support. Demographic and profile data is also collected at our site. We use this data to tailor the visitor's experience at our site, showing them content that we think they might be interested in, and displaying the content according to their preferences. This information is shared with advertisers and other third parties on an aggregate basis.
Unless stated otherwise, we do not request contact information for a mobile phone, text messaging or any wireless device that includes a domain name address (such as ".net" or ".com") as part of the contact information. Federal law prohibits the sending of commercial email messages directly to a wireless device that uses a domain name, unless you have first given your affirmative consent. We may inadvertently collect a wireless device number that includes a domain name when you send us an inquiry or register for a contest or membership club. However, we will not knowingly use that contact information for sending commercial email. We reserve the right to respond to user inquiries or requests sent via a wireless device that uses a domain name as such messages are not deemed to be commercial email and therefore, are not regulated by Federal law. However, when "computer to phone" commercial emails are prohibited by law, we may reject your wireless device contact information when such information is submitted for certain Site features or services. We will attempt to notify you if we will need new contact information.
For specific purposes (such as the purchase of goods and services) we may request a type of confidential personally identifiable information which shall be called "Sensitive Personal Information" and is defined as any individual's: (1) social security number; (2) driver's license number or state identification card number; or (3) account number, credit or debit card number, in combination with any required security code, access code or password that would permit access to an individual's financial account. This Sensitive Personal Information will only be used to implement the specific activity or event it was submitted for. We will not share your Sensitive Personal Information with Advertisers.
However, more general Personal Information will be used to implement the specific activity or event and will also be used for the marketing of additional events, services and merchandising for this Site and the Operators.
If you sign up for an email newsletter or alert, we will use your email address to deliver the newsletter or alert requested. To opt-out of any newsletter or alert, click the unsubscribe link at the bottom of the email or alert you received or go to Subscriptions and uncheck the box or boxes for the newsletters or alerts you wish to opt-out of.
DISCLOSURE TO ADVERTISERS
Advertising support allows us to offer, free of charge, many great activities and services to our users such as contests, sweepstakes and special events. Therefore, we may also use your Personal Information for the marketing of events, products or services of our generous Advertisers. There are two ways users may receive such information from Advertisers, either indirectly via newsletters, email or direct mail from the Site, or directly from the Advertiser. We may use one or both methods depending on the activity and the Advertiser.
Our opt-in program allows you the opportunity to request to be contacted with additional information, to receive special offers and/or to receive materials from Advertisers. If you elect to opt-in to receive information, materials or special offers from these third parties, you give the Operators permission to transfer your personal information to our partners so they can fulfill your request. You have the option of completing online surveys as a part of the rewards service. Among other things, our surveys ask for demographic information (like income level). The information collected through these surveys is used to tailor our visitors' experience at our site and may be shared with advertisers and other third parties on an aggregate basis.
Our Site also provides users the opportunity to opt-out of receiving communications from us and our Advertisers at the point where we request information about the visitor.
We give users the option to remove their information from our database, to not receive future communications, or to no longer receive our service, by submitting your request to Member Support.
We conduct the collection, management, maintenance and storage of website user information in a secure and commercially reasonable manner using acceptable industry standards of security technology and practices (such as electronic security systems and password protections) to protect against the loss, misuse or alteration of Personal Information. We also request that our operational service providers take such precautions. The Operator databases are accessible only by authorized personnel.
However, please note that when users transmit Personal Information over an unsecured Internet connection, the Site is not responsible for the security of that information during the transmission stage as your email or registration could be copied or intercepted by unknown third parties. We use a secured connection only for the collection of Sensitive Personal Information, which is necessary for the purchase of goods or services, but we do not use a secured connection for other types of activities. Therefore, you understand, acknowledge, and agree that you transmit certain Personal Information over this Site at your own risk.
Although persons of all ages may visit our Site and participate in activities that do not require the collection of Personal Information or Sensitive Personal Information, we do not knowingly or intentionally collect Personal Information or Sensitive Personal Information from children under the age of 13. Except for the limited circumstances listed below, we will automatically reject and delete the registration or entry of any person we believe in good faith to be underage. Any false or fraudulent registration or entry from a minor will be deemed to be ineligible and will disqualify the minor from the receipt of a prize, benefit, or other participation.
Except to meet Federal Communications Commission ("FCC"), or other regulatory and legal purposes, we will not use, store, or disclose any child's Personal Information to a third party without prior parental consent.
This Site may have contests and prizes that could appeal to children. However, we do not knowingly or intentionally collect personal Information from children. If we unintentionally receive Personal Information from children under the age of 13 in relation to this activity, we will comply with the Children's Online Privacy Protection Act of 1998 ("COPPA") and reject and destroy such correspondence upon knowledge of such collection, except for the limited circumstances above. Content: We're looking for creative videos that will engage viewers and help them understand why and how they should check their sprinklers every month for water‐wasting problems and make repairs within 48 hours. There are some legal limits on what you can do (see below and the Official Rules), and we've laid out some basic guidelines, but as long as your video fits within those guidelines, what you put in your video is up to you (live action, animation, personal testimonial, whatever!).
The following is recommended (but not required):
Judging Criteria: A panel of qualified judges will be asked to rate each qualified video based on four criteria:
1. Relevance to 2013 theme and accuracy of information (50%)
2. Creativity and originality (30%);
3. Entertainment value (10%)
4. Video quality (10%)
Who can participate: Any high school student over 14 years old who is a U.S. citizen or permanent resident alien and resides in El Dorado, Sacramento or Placer County or the City of West Sacramento (“Territory”). You must be enrolled in a high school in the Territory to enter the Contest. You may enter as an individual or with a team. You must be supervised and “sponsored” by one of your teachers in order to enter. If you are under 18, you must have permission from your parent or guardian to enter and submit a video. Any minor shown in the video must also have permission from their parent or guardian. We will verify that you have all necessary permissions before awarding the prize. You can participate in teams
as long as all your team members meet the eligibility criteria.
Length: Your video can be no longer than 25 seconds. Video must begin and end with 5 seconds of black. Black will not count towards the total running time of the film. If you submit a longer video, we reserve the right to disqualify you or judge only the first 25 seconds of the video. We reserve the right to edit the video to accommodate length or for any other reason.
Format: Submissions will be accepted online only. We require that you submit your videos as either QuickTime (.mov) or MPEG (.mp2 or .mp4) files.
Respect for Existing Copyright: You and your team members must be the original authors of everything in your video or have permission to use copyright protected material. So while we want you to be creative, you need to be careful. If you're thinking about using existing music, video clips, photos or the like, odds are that someone else owns a copyright to that material and you will need to get the copyright owner's permission before using the material in your video.
Consent from Actors in Your Video: All entrants will be required to declare that they have consent from any people appearing in their Videos (or their parent or guardians if they are under 18). Signed releases may be required.
Water Spots Video Contest Official Rules
CONTESTANTS WHO ARE NOT THE AGE OF MAJORITY MUST HAVE PERMISSION FROM THEIR PARENT OR LEGAL GUARDIAN PRIOR TO PARTICIPATING IN CONTEST.
1. ELIGIBILITY: The Water Spots Video Contest (“Contest”) is open only to high school students who are legal U.S. residents of El Dorado, Sacramento and Placer Counties or the City of West Sacramento (“Territory”), are 14‐19 years of age as of the Contest start date, are sponsored by one of his/her high school teachers (“Teacher”), have parental consent to enter the Contest and have Internet access prior to the Contest start date. Contestants may be a single individual or a group of individuals (referred to as “Contestants” or “Teams”). Enrollment in a high school located in the Territory and sponsorship
by a Teacher will be verified. Teacher must be at least 18 years old and be a teacher in good standing at Contestants’ high school. This Contest is co‐sponsored by the Sacramento Bee, P.O. Box 15779, Sacramento, CA 95852 and Regional Water Authority, 5620 Birdcage Street, Suite 180, Citrus Heights, CA, 95610 (collectively, the “Sponsor” or “Sponsors”). Employees, officers, directors, agents, representatives of Sponsor, the McClatchy Company, the legal, promotion and advertising agencies of any aforementioned entity, the prize provider(s), and their immediate family members (defined as spouse,
mother, father, sisters, brothers, sons, daughters, uncles, aunts, nephews, nieces, grandparents and in‐laws, regardless of where they live) and those living in their household (whether or not related), and each person or entity connected with the production or administration of the Contest, and each parent company, affiliate, subsidiary, agent and representative of any aforementioned entity are not eligible. This Contest is subject to all applicable federal, state and local laws. The Contest Submission Period begins on January 1, 2013, at 12:01 AM Pacific Daylight Time (“PDT”), and ends on Friday, March 22, 2013 at 11:59 PM PDT (the “Contest Submission Period”). ALL ENTRIES MUST BE SUBMITTED DURING THE CONTEST SUBMISSION PERIOD. By participating, Contestants agree to be bound by these Official Rules and the decisions of the judges and/or Sponsor, which are binding and final on matters relating to this Contest.
Only one submission per Contestant or Team. A Contestant may be part of several Teams.
2. HOW TO ENTER: Online Submissions only. Here’s how to enter:
A. Get one of your high school teachers (“Teacher”) to sponsor you and your team to enter the Contest. The Teacher must teach in your high school located in the Territory. Contestants and Teacher are responsible to secure any and all permissions required from your high school in order to participate in the Contest. A Teacher may sponsor more than one Contestant or one Team.
B. Make your own video according to the Submission Guidelines section contained in these rules (“Submission Guidelines”), to explain and inspire others how to check sprinkler systems every month for water‐wasting problems and make repairs within 48 hours. Your video can be as fun and creative as you like within the Submission Guidelines.
C. Once you have created your masterpiece, go to www.sacbee.com/water‐spots with your Teacher and team members during the Contest Submission Period, register, complete the Contest online entry form in its entirety, including all required contact information for the Teacher and each Contestant or Team member, and upload your video submission according to the directions on the screen (the “Submission”). All contact information must be current, accurate and valid. Online Submissions must be received no later than March 22, 2013 at 11:59 PM PDT according to Sponsor’s time. No other methods of delivery will be accepted, including submission by email. All entries received by the end of the Submission Period that are complete and otherwise qualified will be eligible to win (“Qualified Submissions”). Sponsor reserves the right to disqualify any Contestant it finds to be tampering with the entry process or the operation of the Contest or violating these Official Rules. All Submissions become the sole property of Sponsor and will not be acknowledged or returned. Sponsor is not responsible for incomplete, late, lost, delayed, damaged, misdirected, incomplete, void, corrupted, garbled, illegible, or unintelligible submissions and those Submissions are void and will not be accepted; nor is Sponsor responsible for any problems, bugs or malfunctions Contestants may encounter when seeking to enter their Submissions.
3. SUBMISSION GUIDELINES: Your Submission must be a video that effectively communicates and inspires, in an informative and creative way, why and how people should check their sprinkler system every month for water‐wasting problems and make repairs within 48 hours.
A. Video must be no longer than 25 seconds.
B. Video must begin and end with 5 seconds of black. Black will not count towards the total running time of the film.
C. Format must be QuickTime (.mov) or MPEG (.mp2 or .mp4).
D. The maximum audio peak is no more than 12db.
E. Videos must focus on the selected 2013 water efficiency theme: Check sprinkler systems every month for waterwasting problems and make repairs within 48 hours. Videos that focus on indoor water use or a different message will be disqualified. .
F. Submissions should be consistent with the mission of the Regional Water Authority (RWA) a joint powers authority representing 25 water providers and affiliates that have pulled their limited resources to promote water efficiency in the Sacramento region.
G. The following is recommended (but not required):
a. The video may include BeWaterSmart.info as a tagline or reference for viewers to learn more about using water efficiency.
b. The video may include information and tips about how viewers can earn their Blue Thumb by using water efficiently outdoors.
H. Videos must be appropriate for a broad audience since the winning video may be broadcast on the internet or on television by the Regional Water Authority.
I. Please, no personal attacks on anyone.
J. No ad may depict dangerous, harmful or illegal activity or substance, or offensive subject matter as determined at our sole discretion. No ad shall portray the Sacramento Bee or the RWA in a negative light.
All videos must be original works of authorship, created by the Contestant or Team members who submits the entry. Contestants may not copy or otherwise plagiarize the Submission from any source, nor may the video include third‐party copyrighted material, such as music, photographs, or movie snippets, without the copyright holder’s permission. By entering, you warrant that your video does not infringe any third party’s rights, and that you have obtained all necessary permissions from all relevant third parties to submit the Submission. If, in the sole discretion of Sponsor, your Submission constitutes copyright infringement, the Submission will be disqualified. Contestant must hold all rights to the entire video
Submission. Contestant must secure – and finalists will be required to submit – a written release from any actors and/or any other video participant to use their name and likeness under the terms and conditions of these Official Rules. Any actors, music, voice‐overs, or images contained in any Submission must be properly licensed, and evidence of such may be requested by Sponsor at any time during or after the Contest Submission Period. Contestant agrees to indemnify Sponsor against any and all claims of infringement from any third party for any use by Sponsor of video Submission. Any music or
images used in the video Submission must be an original work of authorship under U.S. Copyright Law. Contestants may not be, nor may Contestant use parties who: 1) are represented under contract (e.g., by a talent agent or manager) that would limit or impair Sponsor’s ability to show the video in any media form; 2) have an acting or modeling contract that would make their appearance in the Submission a violation of any third party rights; 3) are under a merchandising agreement; or
4) are under any other contractual relationship, including but not limited to guild and/or union memberships, that may prohibit them from participating fully in this promotion, or from allowing Sponsor to use royalty‐free, the Submission worldwide in all media in perpetuity. No Submission may depict any nudity, animal or plant cruelty, harmful or illegal activity or substances, or offensive, obscene subject matter as determined in our sole discretion. No Submission shall portray Sponsors in a negative light. We
reserve the right to exclude any ad that we believe doesn’t meet the above criteria, at our sole discretion.
4. JUDGING: Judging will be completed in three (3) rounds.
A. First Round: All entries will be prescreened to insure the entries have correctly met the Submission Guidelines and meet with Sponsor’s general standards and practices prior to any judging. (“Qualified Submissions”). At any time before, during or after the Contest Period, Sponsor may, in its discretion, chose to post or distribute one (1) or more Submissions, the Contestant or Team’s name and profile information online (including on Sponsors’ websites, social media sites and affiliated third‐party websites) or on television for promotional purposes only. Posting of this/these Submission(s) will not mean that said Submissions are eligible to win or are a Finalist or Selected Contestant.
B. Second Round: Qualified Submissions will be reviewed and scored by a panel of qualified judges, according to the following criteria:
Up to three (3) Finalists with the most points awarded by the judges will be the potential "Judge's Choice" winners. The video with the highest number of points awarded by the judges will be deemed the first place winner/grand prize winner. The video with the second highest number of points from the judges will be deemed the second place winner. The video with the third highest number of points from the judges will be deemed the third place winner. In the event of a tie, the tying submissions will be rescored in order to determine a Selected Contestant.
C. Third Round: Up to ten (10) Submissions with the highest score will be selected as finalists to move to the public voting round (“Finalists”). In the event of a tie, the tying submissions will be rescored in order to determine a Selected Contestant. Sponsor reserves the right to include all tying submissions as Finalists. Public Voting Round. On or about April 15, 2013, the Finalists’ Submissions, names, schools and hometowns will be posted on www.sacbee.com/water‐spots for review and voting by the public for approximately one (2) weeks up to and including April, 26, 2013 at 11:59 PM PDT (the “Voting Period”). You must register on the site to be able to submit a vote. Only one vote per registered user.
Sponsor reserves the right to distribute or display the Finalists’ videos in any media and on any website. Contestants understand that users of these sites may share, embed, comment on (including negatively) and re‐post their Submissions during and after the Voting Period. Sponsors are not responsible and shall have no liability for such conduct. One (1) finalist with the most votes tallied during the Voting Period will be the potential "People's Choice" winner. Use of bots, devices and other programs to increase views or votes is prohibited. In the event of a tie, the Sponsor reserves the right to post the tying submissions for an additional three (3) days in order to determine Finalists or include all tying submissions as Finalists . The Teacher, individual Contestant and/or all Team members of a potentially winning Team are
hereby collectively referred to as “Selected Contestants.” For advertising purposes, the selected winners may be required to resubmit their video in one of the following formats: (1) Standard Definition (SD) Format Tape or (2) High Definition (HD) Digital Files.
5. NOTIFICATION AND RELEASES: Sponsor or Sponsor’s representative will notify each Selected Contestant that his or her team is a Selected Contestant, by phone or email in Sponsor’s discretion using the contact information provided at the time of Submission (“Notification”). Each Selected Contestant will be required to respond (as directed) to the phone and/or email notification within twenty‐four (24) hours of attempted notification. The failure to respond timely to the notification may result in forfeiture of the Prizes; and, in such case, Sponsor may choose the next highest scoring entry from among the
remaining eligible entries. Each Selected Contestant will also be sent an affidavit of eligibility / liability / publicity release, and verification of copyright form (“Release”) using the contact information provided at the time of Submission. The Release must be signed and returned by each Selected Contestant (or by the member’s parent or legal guardian if he/she is a minor) within five (5) days of Notification. Unless restricted by law, each Selected Contestant will be required to complete and return the Release within the time period specified therein. The failure of any Teacher or any Team member to timely return the signed Release, including any and all parental consents, may result in forfeiture of the prize for the entire Team. The Release will include permission by the Selected Contestant to allow Sponsors to use the Submission in any and all advertising and promotion throughout the world without additional compensation, unless prohibited by law. Should any Selected Contestant (or Selected Contestant’s parent or legal guardian if he/she is a minor) be unwilling or otherwise unable to provide such permissions and or releases, the entire Selected Contestant Team will not be disqualified and another Selected
Contestant may be selected, at Sponsors’ sole direction and if time allows. An alternate Selected Contestant may be randomly selected from among the remaining eligible Submissions if any of the
Selected Contestants: (i) cannot be reached; (ii) fails to obtain all signatures on the Release and to return the documents in a timely manner as required pursuant to these Official Rules; or (iii) cannot accept or receive the prize for any reason. Every Selected Contestant will be required to show proof of identification, residence and age, as well as provide copies of any and all parental permissions and other releases and permissions required under these rules. Except where prohibited by law, Selected Contestants must allow Sponsors to use their name, hometown, likeness, voice and photograph for advertising, press and promotional purposes. The name, school, hometown and Submission of Selected Contestants may be announced and posted on Sponsor’s website(s) and social media pages on or around May 5, 2013 and their video may potentially be aired at a Sacramento River Cats game in Spring 2013, in Sponsor’s discretion. One or more winning video(s) may also be used in the Regional Water
Authority television advertising buys during Summer 2013.
6. LICENSE: As a condition of receiving any prize, all Selected Contestants (or Selected Contestant’s parent or legal guardian if he/she is a minor) hereby provide a One Hundred Eighty (180) day exclusive irrevocable worldwide license to Sponsors after which time, Sponsors shall retain a perpetual non‐exclusive license to use the submitted video in any and all media throughout the world, in perpetuity, for any purpose whatsoever, without any additional compensation, the term of which shall be the entire life of the copyright. Should any Selected Contestant be unwilling or otherwise unable to enter into license, or provide permissions and or releases or otherwise cannot accept or receive the prize for any reason, Contestants with the next highest score will be chosen from the remaining entries until one who is able to meet all requirements can be selected. All potential prize winners must provide Sponsor with all signatures on required paperwork and return all documents in a timely manner as required pursuant to these Official Rules in order to be eligible to receive the prize. Contestants may not resell, assign or transfer any of their rights in their Submissions under these Official Rules.
CONTESTANTS AND TEACHERS WILL NOT BE PAID FOR THEIR SUBMISSIONS or for granting Sponsor any of these rights. While Sponsor will seek to post video Submissions in the form as provided at the time of entry, all Contestants agree that due to technical limitations and other reasons, videos may be edited or altered from their original form and that Sponsor reserves the right to re‐shoot, edit or modify the Submission in its sole discretion. Sponsor may post videos in any order or sequence, with or without commentary, and may select the excerpt of video to serve as a thumbnail in its sole discretion.
Sponsor shall have no liability as to posting of videos.
7. PRIZES. If eligible under these Official Rules, four (4) Selected Contestants will receive the following prizes will be awarded:
A. JUDGE'S CHOICE
One (1) First Prize: Teacher will receive one (1) cash prize of $250; the individual student Contestant or the Team (as applicable) will receive one (1) cash prize of $250 to divide among themselves. Approximate RetailValue (“ARV”) of First Prize: $500.
One (1) Second Prize: Teacher will receive one (1) cash prize of $150; the individual student Contestant or the Team (as applicable) will receive one (1) cash prize of $150 to divide among themselves. ARV of Second Prize: $300.
One (1) Third Prize: Teacher will receive one (1) cash prize of $50; the individual student Contestant or the Team (as applicable) will receive one (1) cash prize of $50 to divide among themselves. ARV of Third Prize: $100.
B. PEOPLE'S CHOICE
One (1) People's Choice Prize: Teacher will receive one (1) cash prize of $300; the individual student Contestant or the Team (as applicable) will receive one (1) cash prize of $300 to divide among themselves OR an iPad mini. ARV of People's Choice Prize: $600
Total ARV of prizes: $1,500.
Teacher cash prizes will be in the form of a check or other mode of payment, in Sponsor’s discretion, payable to the Teacher named in the winning entry. Student cash prizes will be in the form of a check or other mode of payment, in Sponsor’s discretion, payable to one of the Contestants named in the winning entry, selected in Sponsor’s sole discretion. All prizes will be shipped to addresses within the Territory only. One prize per household. For avoidance of doubt, the student cash prize is awarded to the entire team (not each member); team members are responsible for allocating and/or dividing the cash prize among themselves. Sponsor is not liable for any disputes amongContestants or Team members regarding distribution of the cash prize. For example, if a team of 10 students wins the $250 cash prize, the check will be made payable to one team member (selected in Sponsor’s sole discretion) and team members
will be responsible for dividing that prize among themselves as they see fit. For all prizes, all federal, state and local taxes and other expenses in connection with the prize are the sole responsibility of
the Selected Contestant (or Selected Contestant’s parent or legal guardian if Selected Contestant is a minor). Selected Contestants are solely responsible for any other unspecified expenses related to prize. All activities related to the prize, are at the Selected Contestants’ own risk and subject to whatever restrictions are imposed by the entities that govern activities. Selected Contestants not entitled to any surplus between actual retail value of prize and stated ARV and any difference between stated ARV and actual value of the prize will not be awarded. No substitution, transfer, or cash redemption of
prize, provided however that Sponsor reserves the right to substitute a prize with another prize of equal or greater value should the advertised prize become unavailable for any reason. In the event of noncompliance with the foregoing requirements or if prize notification is returned as undeliverable, prize will be forfeited and, at Sponsor’s discretion, an alternate Selected Contestant will be selected. Sponsor is not responsible for lost, misdirected or undelivered Prizes.
8. CONDITIONS: Contest is subject to these Official Rules. By participating, Contestants (or Contestant’s parent or legal guardian if Contestant is a minor) agree: (i) to be bound by these complete Official Rules and the decisions of Sponsor which shall be final and binding; and (ii) to waive any right to claim ambiguity in the Contest or these Official Rules, except where prohibited by law. By accepting a prize, Selected Contestant agrees to release Sponsors, The McClatchy Company, including their parent, subsidiary and affiliated entities together with the respective directors, employees, officers,
licensees, licensors and agents, and respective advertising and promotion entities and any person or entity associated with the production, judging, or administration of the Contest (collectively, the “Releases”) from any and all liability, loss or damage arising from or in connection with awarding, receipt and/or use or misuse of prize or participation in any prize related activities. Releases shall not be liable for: (i) telephone system, telephone or computer hardware, software or other technical or computer malfunctions, lost connections, disconnections, delays or transmission errors; (ii) data corruption,
theft, destruction, unauthorized access to or alteration of entry or other materials; (iii) any injuries, losses or damages of any kind, including death caused by the prize or resulting from acceptance, possession or use of a prize, or from participation in the Contest; or (iv) any printing, typographical, administrative or technological errors in any materials associated with the Contest. Sponsor disclaims any liability for damage to any computer system resulting from participating in, or accessing or downloading information in connection with this Contest. Sponsor reserves the right to cancel or suspend the Contest, in its sole discretion, should it receive fewer than 50 entries, or receive no entries that have a judged score above 60 points, or due to circumstances beyond its control, including natural disasters. Submissions will not be
returned and may be destroyed. Sponsor may prohibit an entrant from participating in the Contest or winning a prize if, in its sole discretion, it determines such entrant is attempting to undermine the legitimate operation of the Contest by cheating, deception, or any other unfair playing practices of intending to annoy, abuse, threaten, undermine or harass any other players or Sponsor representatives. The internal laws of the State of California will govern disputes regarding these Official Rules and/or this Contest. Taxes, if any, are the sole responsibility of Selected Contestant, and Contestants may be
issued an IRS Form 1099 for the ARV of any awarded prize. Sponsor is not responsible and shall not be held liable, and your entry may be disqualified and may not be considered for any Prize, should your Submission be removed from any third‐party video hosting site for any reason (including without
limitation DMCA take‐down), or should your Submission be unavailable for any time during the Public Voting Period. Sponsor reserves the right, in its sole discretion, to cancel, modify or suspend the Contest should a virus, bug, computer problem, unauthorized intervention or other causes beyond Sponsor’s control, corrupt the administration, security or proper play of the Contest. Sponsor may prohibit an entrant from participating in the Contest or winning prize if, in its sole discretion, it determines such entrant is attempting to undermine the legitimate operation of the Contest in any way by cheating, hacking, deception, or any other unfair playing practices of intending to annoy, abuse, threaten or harass any other players or Sponsor representatives. Use of automated entry devices or programs is prohibited. Any attempts to access the site, enter the Contest or increase votes or views via a bot script, device or brute‐force attack will result in disqualification, including that IP address becoming ineligible for the entire Contest. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND WILL RESULT IN DISQUALIFICATION FROM PARTICIPATION IN THE CONTEST. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY
FEES) TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.
9. PUBLICITY: Sponsor reserves the right to use the Submissions to the Contest for publicity purposes prior to, during, or after the Contest end date, in any media, and to use the name, likeness, hometown name, of any Contestant, including all or part of their video throughout the world, in perpetuity, without any compensation or prior review unless specifically prohibited by law.
10. WAIVER OF JURY TRIAL: Except as prohibited by applicable law and as a condition of participating in this Contest, each Contestant (or Contestant’s parent or legal guardian if Contestant is a minor) hereby irrevocably and perpetually waives any right s/he may have to a trial by jury in respect of any litigation directly or indirectly arising out of, under or in connection with this contest, any document or agreement entered into in connection herewith, any prize available in connection herewith, and any of the transactions contemplated hereby or thereby.
11. PRIVACY: All personal information collected by Sponsors will be used for administration of the Contest and in accordance with Sponsors’ privacy policies. Entrants may be sent promotional material by Sponsors. Please refer to Sponsors’ privacy policies located at http://www.sacbee.com/privacy‐policy/ and http://www.swrcb.ca.gov/privacy_policy.shtml for important information regarding the collection, use and disclosure of personal information by Sponsors.
